Time Warner Cable Appeals FOIL Ruling Requiring Release of Broadband Plans, Service Quality Information
The Utility Project is urging dismissal of the petition for takeover of Time Warner Cable by Comcast for a number of reasons, including the failure adequately to address plans for working toward affordable, universal, high speed broadband. In a September 3, 2014 ruling, a PSC Administrative Law Judge ruled that information including broadband plans and customer service staffing filed with the PSC by Time Warner Cable is not a trade secret and must be released under the Freedom of Information Law (FOIL). On September 15, 2014, Time Warner Cable appealed the A:J’s decision to the Commission Secretary, who makes final FOIL decisions for the PSC. As a consequence the Time Warner Cable broadband plans filed with the PSC are not public at this time.
